What each vendor's terms say about commercial use

What each vendor keeps: rights over public work, or a licence over all of it

For public content Leonardo.Ai retains worldwide perpetual rights to use, adapt, modify, publish and create derivative works. Hailuo takes a non-exclusive, worldwide, royalty-free licence over the content generated through the service. As of 2026-09-22.

1Every hosted product keeps something

Both of these vendors decline to own the output and both reserve the ability to use it. That is the normal shape of a hosted service, and the interesting question is not whether something is kept but whether the customer can opt out of it.

On one row they can, by keeping a generation private, and the page says what that changes. On the other the licence is stated without an exit, and nothing on the page describes a way to narrow it.

2The two clauses are worded for different purposes

Retained rights over public content read like the terms of a gallery: the platform displays work, other users copy and remix it, and the clause supports that. A general licence over generated content reads like the terms of an operator holding files.

Read that way neither is surprising. What differs is visibility: one clause is tied to a feature a customer can see and switch, the other applies to everything and is only noticeable if the terms are read.

3What to ask before signing an NDA over this work

Whether the supplier may use client material in its own promotion, and whether anything in the account is visible to other customers by default. The first row answers the second question explicitly; the second row answers neither in the wording read here.

Those are the two questions a confidentiality obligation turns on, and they are questions about the retained clause rather than about the ownership sentence that precedes it.

4A third set of terms on the same question

How SceneMixer's terms answer what is owned, beside Leonardo.Ai and Hailuo AI. Recorded 2026-10-13.

The first column comes from the help centre answer at leonardo.ai, read 2026-09-22; the second from the subscription service terms at hailuoai.video, read 2026-09-22. Each vendor’s full row is on Leonardo.Ai and Hailuo AI, and the column being compared is described on what is owned. A comparison of wording is not legal advice.
